For mere use of the website for informational purposes, these terms of use serve as legal notices. Upon opening a user account, the terms of use become part of the contractual relationship between the user and Houzy. Houzy may also make the opening of a user account and the use of individual functions contingent on acceptance of the terms of use.
1 DEFINITIONS
For the purposes of these terms of use, the following terms mean:
2 SERVICES PROVIDED BY HOUZY
Houzy operates a platform through which users can retrieve information, have properties indicatively valued, and submit quote requests to partners.
Houzy solely arranges the contact. Houzy does not become a party to any contract concerning the performance of work between the user and the partner, and acts neither as a representative of the user nor as a representative of the partner.
Contracts for craftsman services, consulting services, brokerage services, financing, or other services are concluded exclusively between the user and the respective partner. The user and the respective partner are solely responsible for the content, conclusion, performance, quality, any warranty rights, and termination of such contracts.
3 QUOTE REQUESTS AND REFERRAL PROCESS
The user may submit non-binding requests on the platform for craftsman or related services and describe their project. Submitting a request does not constitute a binding offer by the user to Houzy or to any partner.
Prior to forwarding a request to a partner, Houzy may technically and substantively evaluate, categorize, and summarize it, and supplement it with non-binding orientation information, in particular regarding the description of the project, the work category, and an estimate of scope and price. This information is non-binding and may differ from the user's information. The request is displayed to partners in this processed form. It serves solely for initial orientation and does not replace either a review by the partner or a binding quote.
Houzy may, at its own discretion, forward the request to one or more suitable partners. The user has no entitlement to forwarding, to being contacted by a partner, to a specific number of quotes, to specific partners, or to the conclusion of a contract. Houzy does not guarantee any economic success.
Houzy may review partners prior to their admission to the platform based on selected criteria, in particular identity/company information and proof of insurance, and may continuously review the collaboration. However, this review does not guarantee the partner's professional qualifications, creditworthiness, availability, or quality, nor performance of the contract. It does not replace the user's own assessment. The choice of partner and the decision on a quote rest with the user.
4 DISCLOSURE OF CONTACT DATA
Houzy discloses the user's contact data, such as name, telephone number, and e-mail address, only when the partner expresses interest in taking on the request and the disclosure is necessary for processing the request, or when the user authorizes the contact. It is up to the user to decide whether a contact and an assignment result from this.
Partners may use this data solely in connection with the relevant request. They are prohibited from passing it on or selling it to third parties. The respective partner is solely responsible for processing the data in compliance with data protection law after disclosure.
5 USER ACCOUNT AND COCKPIT
For certain functions, the user opens a personal account. Login may take place via a login link sent to the registered e-mail address. The user provides truthful information and keeps it up to date.
Access is personal. The user keeps their access data safely and does not pass it on to third parties. They inform Houzy without delay if they discover or suspect unauthorized use of their account.
The user may have their account deleted at any time. Deletion terminates access to the Cockpit and the requests stored there. Houzy cannot recall contact data that was disclosed to partners before deletion with the user's consent; the respective partner is responsible for its further processing. Otherwise, the privacy policy applies.
Houzy may temporarily block or permanently terminate access to the platform or user account if the user violates these terms of use, provides false information, infringes third-party rights, endangers the security or integrity of the platform, misuses the platform, or if any other objective reason exists. In doing so, Houzy gives appropriate consideration to the user's legitimate interests.
6 CONTACT AND CHAT
A partner to whom a request has been assigned may exchange messages with the user via the platform. The message history and any attachments are stored in the Cockpit and remain retrievable until the request or the account is deleted. Houzy does not owe uninterrupted availability, delivery, or acknowledgment of such messages. In doing so, the user may view the partner's profile. Houzy is not obliged to monitor the content of communication between users and partners. However, Houzy may review, block, remove content, or report it to the relevant authorities to the extent necessary or appropriate to combat abuse, resolve errors, or comply with a legal obligation.
7 USER CONTENT
The user undertakes to provide complete, current, and truthful information when using the platform. They may not use the platform in an abusive or unlawful manner, or in a manner that infringes the rights of Houzy, partners, or third parties.
The user ensures that they hold the rights to the content they submit or upload on the platform, in particular photographs and plans, and that such content does not infringe any third-party rights.
The user grants Houzy the right to store, process, and pass on such content to partners for the purpose of referral. Any use beyond this, in particular for advertising purposes, requires the user's separate consent.
8 WARRANTY FOR CONTENT ON THE HOUZY PLATFORM
The content and functionalities provided via the platform serve informational purposes only and do not replace advice. Houzy applies due care with respect to the accuracy, completeness, availability, and reliability of this information and these functionalities. However, no warranty, whether implied or express, is given, in particular not for the correctness or completeness of the underlying data analyzed, the automated calculations and assessments based thereon, copyrights and other rights, merchantability, or fitness for a particular purpose. This also applies in particular to processed requests pursuant to Section 3. Automated valuations serve only as non-binding orientation aids; for example, the automated property valuation does not replace a market value appraisal. The information offered on the Houzy platform does not relieve the user of the need to make their own decisions and assessments or to seek advice.
Houzy reserves the right to change all content without prior notice. Houzy is not obliged to update or keep current the information contained herein.
9 LIABILITY AND WARRANTY
Houzy is liable for damages caused by intentional or grossly negligent conduct by Houzy, in accordance with statutory provisions.
To the extent permitted by law, any further liability of Houzy, its corporate bodies, employees, and auxiliary persons for damages in connection with the use of the platform is excluded.
In particular, liability is excluded for indirect damages, consequential damages, lost profits, and damages resulting from interruptions, restrictions, or other disruptions to the availability of the platform.
Houzy assumes no warranty or liability for the conduct of partners, the quality of services provided by partners, or claims arising from contracts that the user concludes directly with a partner. Houzy's liability for partners and other third parties is excluded to the extent permitted by law.
10 INTELLECTUAL PROPERTY RIGHTS AND LICENSE PROVISIONS
All intellectual property rights and other rights to the content provided on the platform, in particular texts, data, graphics, logos, software, and databases, belong to Houzy or the respective rights holders.
Subject to the rights to content that the user submits or uploads themselves on the platform, no rights to the platform or its content are transferred or granted to the user, other than the limited usage rights expressly required for the contractual use of the platform. Rights to content submitted by the user themselves are governed by Section 7.
The user may use, store, or print individual content or parts of the Houzy platform only within the scope of the functions provided by Houzy and exclusively for their own private or internal purposes, provided that all notices regarding intellectual property rights are retained unchanged.
Without the prior written consent of Houzy, the user is prohibited from, among other things, modifying, copying, reproducing, distributing, making publicly available, transmitting, publishing, licensing, embedding in another website or platform, using as a frame, creating derivative works from, or otherwise using content of the platform, in whole or in part, for commercial, public, or unlawful purposes. Without other authorization from Houzy, it is further prohibited to systematically retrieve content from the Houzy platform in order to directly or indirectly compile a collection, database, or directory.
Houzy reserves the right, in the event of a violation of these provisions, to block access to the Houzy platform, to suspend or delete user accounts, and to take further legal action.
11 DATA PROTECTION
Houzy processes personal data in connection with the platform in accordance with the Swiss Data Protection Act. The details of the processing of personal data, in particular the categories of data processed, the purposes, the recipients, and the retention and deletion periods, are set out in the privacy policy. The privacy policy is mentioned for informational purposes only and is NOT part of these terms of use.
To the extent that the user interacts with partners via the platform or data is disclosed to partners, these partners process personal data under their own responsibility, provided that they themselves decide on the purposes and means of further processing.
12 COOPERATION WITH THIRD PARTIES
Use of the platform is free of charge for the user, unless expressly stated otherwise. Houzy AG cooperates with selected third parties, in particular craftsman businesses and mortgage providers. If a user concludes a contract with a third party as a result of such cooperation, Houzy AG may receive compensation for this.
Houzy AG is not obliged to enable the conclusion of a contract between the user and a third party. Likewise, Houzy assumes no duty to safeguard the user's interests vis-à-vis third parties. Houzy does not offer a complete market comparison and does not owe the selection of the most favorable or objectively best partner. The presentation, selection, or order of partners may depend on various criteria, in particular geographic proximity, availability, work category, quality experience, technical criteria, and, where applicable, contractual relationships with Houzy. The decision to conclude a contract rests exclusively with the user and the respective third party. Houzy has no influence whatsoever on this.
13 CHANGES TO THESE TERMS OF USE
Houzy reserves the right to adapt these terms of use at any time, in particular in the event of further development of the platform, changes to the functions offered, legal changes, or adjustments to business processes. Houzy notifies registered users of material changes in an appropriate manner, e.g. by e-mail or in the Cockpit. If the user does not object to the amended terms within the notified period, or continues to use the platform after the amendments take effect, the amended version is deemed accepted.

14 SEVERABILITY CLAUSE
Should individual provisions of these terms of use be or become invalid or unenforceable, either now or after conclusion of the contract, the validity of the remainder of the agreement shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come as close as possible to the economic purpose that the contracting parties pursued with the invalid or unenforceable provision.
15 GOVERNING LAW AND PLACE OF JURISDICTION
This contractual relationship shall be governed by Swiss law, excluding its conflict-of-law provisions.
The exclusive place of jurisdiction is Zurich, Switzerland, to the extent no mandatory statutory place of jurisdiction applies.
